2. This writ petition has been filed with seeking following relief :- “i. Allow Present Petition.
ii. Reject application 22 ? dated 16.05.2024 filed by defendant -respondent to set aside ex-parte order dated 01.03.2024 in original suit 08/2023 Rupendra Kumar Kashyap Vs Dr Arvind Jain pending before Civil Judge (Junior Division) Agra,same being violative of Order IX Rule 7 of CPC 1908 (Annexure-2 of this petition)
iii. Direct trial court Civil Judge (Junior Division) Agra to decide/ conclude trial of Original Suit 08/2023 Rupendra Kumar Kashyap Vs Dr Arvind Jain, pending before it, expeditiously to secure end of justice to petitioner.”
