[1] Heard Mr. Ajoy Pebam, learned counsel for the petitioner.
[2] The petitioner is one of the six bidders who submitted his bid
in the NIe-T dated 18.07.2025 bearing No. EE-II/EEW/T-15/E-
TENDER/2025-26/31 for construction of 50 (fifty) bedded girls hostel
under Dharti Aaba Janjatiya Gram Utkarsh Abhiyan (DA-JGUA), 2025-
26 at Old Tamenglong Junior High School, Tamenglong, Manipur issued
by the Executive Engineer, Division-II, Education Engineering Wing,
Education (S) Department, Manipur and the same department also
issued another NIe-T dated 18.07.2025 bearing No. EE-II/EEW/T-15/E-
TENDER/2025-26/31 for construction of 50 (fifty) bedded boys hostel
under Dharti Aaba Janjatiya Gram Utkarsh Abhiyan (DA-JGUA), 2025-
26 at Old Tamenglong Junior High School, Tamenglong, Manipur.
[3] The petitioner has submitted his bid only in the NIe-T dated
18.07.2025 for construction of fifty bedded girls hostel. Out of the six
bidders, four bidders including the petitioner and respondent Nos. 5 to 7
are declared as technically responsive and respondent No. 5 is L1 and
petitioner is L2 in the financial bid evaluation.
[4] The technical bid evaluation dated 02.09.2025 for
construction of fifty bedded girls hostel is challenged on the ground that
respondent No. 5 who submitted bids in both the NIe-Ts for construction
of fifty bedded hostels for girls and boys, has submitted the same EMD
bearing the same number i.e. HDFCR52025072995678147 and it is
submitted that it is in violation of the terms of the tender at para 1.16.
[5] Issue notice to the main petition as well as application for
interim relief.
