    1. Heard Shri Ravishek Dixit, the petitioner in person.

    2. Ms. Tarannum, learned counsel has filed her vakalatnama on behalf of sole opposite party, which is taken on record.

    3. This petition has been filed challenging the order dated 01.12.2025, whereby learned Principal Judge, Family Court, Shahjahanpur has rejected Application 9-C, which was filed for exempting cooling off period.

    4. The petitioner submits that both the parties have filed joint petition under Section 13-B of Hindu Marriage Act seeking dissolution of their marriage. They are residing separately for the last more than four years and have already entered into a settlement. It is further contended that circumstances are of such nature whereunder the grant of decree for dissolution of marriage based upon the mutual consent at the earliest is necessary and, therefore, the order impugned may be set aside.

    5. Ms. Tarannum, learned counsel appearing for opposite party does not have any objection to the prayer made.

    6. Considering the age of the parties to the marriage, the contents of the petition for dissolution of marriage, application 9-A as well as settlement arrived at between the parties and following the law laid down by the Hon’ble Supreme Court in the case of Amardeep Singh vs. Harveen Kaur: Civil Appeal No. 11158 of 2017, decided on 12.09.2017, and in the interest of justice, this Court is inclined to allow the petition.

    7. The petition is allowed.

    8. The order dated 01.12.2025 passed by the Principal Judge, Family Court, Shahjahanpur in Case No. 1031 of 2025 (Ravishek Dixit vs. Smt. Lakshmi) is hereby set aside.

    9. The court concerned is directed to take up the divorce petition by fixing a date in the month of March, 2026 and in case, both the parties appear on the date fixed and make statement in consonance with the terms of the settlement, final order shall be passed in the matter.
