This writ petition has been filed under Article
226
of the Constitution of India by the petitioner-Unit
praying for a reasonable time to deposit the environmental
compensation imposed upon him to the tune of
₹8,68,688/- in suitable installments.

2. The petitioner-Unit runs automobile service
center operating under the name and style of M/s Ajay
Motors and is engaged in servicing, washing, denting and
painting of the motor vehicles.

3. The respondent-Uttarakhand Pollution Control
Board through its Officer found the petitioner-Unit
polluting the environment by not following the environment
provision as prescribed under The Water (Prevention and
Control of Pollution) Act, 1974
and The Air (Prevention and
Control of Pollution) Act, 1981
. Consequently a show-cause
notice was issued to the petitioner-Unit on 02.12.2022 and
environmental compensation order was passed on
13.06.2023 when petitioner-Unit did not appear on the
show-cause notice.

4. The environment compensation was assessed
against the petitioner-Unit to the tune of ₹9,68,688/-. The

petitioner-Unit deposited a amount of ₹1,00,000/- towards
the said environment compensation on 09.08.2023 by way
of a demand draft, but failed to deposit the rest of the
amount for which now the recovery citation has been
issued.

5. The petitioner has filed this writ petition only
on the premise requesting for making easy instalments of
remaining balance in the environment compensation to
be paid to the petitioner.

6. Learned counsel for respondent nos.1 and 2
has no objection if such an order is passed by this Court.

7. Accordingly writ petition stands allowed.
Petitioner shall deposit the balance amount of the
environmental compensation amounting to ₹8,68,688/-
in four quarterly easy instalments of ₹2,00,000/- within a
year. The first instalment shall be paid on or before
12.04.2026.

8. It is clarified that the fourth instalment shall
accompany the balance of the amount. It is also provided
that if the petitioner fails to make payment of any of the
instalments of the environmental compensation as directed
by this Court, the respondent shall be free to recover the
entire balance amount, in accordance with law at one go.
