AWARD

1. The present second appeal has been filed against the judgment
and decree dated 28.02.2017 passed by the learned Second
Additional District Judge, Bilaspur, District Bilaspur (C.G.) in Civil
Appeal No. 24-A/2016 between Bisahu Ram & others Vs.
Duwasiya Bai & others (Annexure A/1), which arises out of the
judgment and decree dated 14.03.2016 passed by the learned
10th Civil Judge Class-II, Bilaspur, District Bilaspur (C.G.) in Civil
Suit No. 283-A/2015 between the same parties (Annexure A/2).

2. It is submitted that the parties to the present appeal are close
family members, and the dispute giving rise to the present
proceedings has been amicably settled through a family
settlement between them. As per the terms of the said settlement,
respondent No.1 – Duwasiya Bai has agreed to declare the
questioned property in favour of the appellants, and in lieu thereof
she has also agreed to receive other property from the appellants
towards her equal share. They have already filed an application
under Order 23 Rule 3 of the CPC along with compromise deed
dated 11.09.2025, before this Court.
3. In view of the aforesaid settlement and mutual compromise
arrived at between the parties, the dispute involved in the present
appeal stands amicably resolved to the full satisfaction of the
parties. The settlement has been entered into voluntarily and with
the free consent of the parties, in order to put an end to the long-
standing litigation and to maintain peace and harmony within the
family. Consequently, no dispute now survives between the parties
with regard to the subject matter of the present appeal
4. Accordingly, the appeal stands disposed of in terms of the
compromise arrived at between the parties.
