Leave granted.

We have heard the learned counsel appearing for

the parties.

The present appeal has been filed by the

appellant seeking anticipatory bail in connection

with Complaint Case No.549/2023 registered for the

offence punishable under Section 498-A of the Indian

Penal Code, 1860.

The dispute between the appellant and respondent

No.2 was referred to the Supreme Court Mediation

Centre vide order dated 09.09.2025.

Learned counsel appearing for the parties submit

that the matter has been amicably settled between the

appellant and the respondent No.2 through the

mediation process.

As per the Settlement Agreement dated
18:03:07 IST
Reason:

17.01.2026, the parties have resolved all the

disputes amicably and have no claims against each

other or their respective family members including

maintenance or any movable or immovable property.

It is also submitted that the parties would

abide by the terms and conditions mentioned in the

settlement arrived at between the parties.

The following case is pending between the

parties:

“(i) Respondent No.2/wife has filed a Complaint
Case No.549/2023 dated 09.05.2023 under
Sections 498A, 494, 385 and 34 of the Indian
Penal Code and Sections 3 and 4 of the Dowry
Prohibition Act, pending before the learned
CJM, Patna, registered as P.S. Patna.”

In view of the settlement having been arrived at

between the parties, the above pending proceeding

shall stand closed.

Learned counsel appearing for the parties pray

that this Court may invoke its extraordinary

jurisdiction under Article 142 of the Constitution of

India and grant a decree of divorce between the

parties by invoking our power under Article 142 of

the Constitution of India.

Accordingly, by invoking our power under Article

142 of the Constitution of India, there shall be a

decree of divorce between the appellant and the

respondent No.2 by mutual consent. A decree of

divorce shall be drawn up accordingly.

It is further agreed between the parties that

the present proceeding shall stand closed subject to

the condition that the petitioner shall comply with

the terms and conditions of the settlement.

The Settlement Agreement shall form a part and

parcel of the order.

The appeal stands disposed of, accordingly.

Pending application(s), if any, shall also stand

disposed of.
