1. By reference to FIR No. 258/2025 dated 30th November

2025 for the alleged commission of offences under Sections

64, 127(2), 351, 88, 61 of Bharatiya Nyaya Sanhita (BNS)

and 5(j) (ii) & 16 of the Protection of Children from Sexual

Offences Act (POCSO Act) 2012 registered by the Police

Station Shopian, a Final Police Report No. 02 of 2026 dated

27th January 2026 under section 193 of Bhartiya Nagarik

Suraksha Sanhita (BNSS) 2023 for alleged commission of

offences under sections 61,62,64,127(3),89,238,239,240,351,

and 53 of the Bhartiya Nyaya Sanhita (BNS) 2023 and

4,5(j) (ii)/6,17,19 and 21 of the POSCO Act, 2012 came to

be laid.

2. In said Final Police Report (Charge-Sheet) which has come to

be submitted on file No. 4/2026 before the court of Principal
Sessions Judge, Shopian on 28th January 2026, five

accused persons have been named, namely:

1) Sudais Ahmad Lone as Accused No.1

2) Gh. Mohd Lone (father) as Accused No.2

3) Mst. Parveena Akhter (mother) as Accused No.3

4) Falak Jan (sister) as Accused No.4, and

5) Zahid Iqbal as Accused No.5.

3. Out of said five accused persons, accused No. 1, 2 & 5 are in

custody, whereas two women i.e., Accused No.3 and

Accused No.4, are shown to be absconding but who have

come forward with the present petition seeking the relief of

pre-arrest bail under Section 482 of the Bharatiya Nagarik

Suraksha Sanhita (BNSS), 2023.

4. This petition is disposed of at its very inception stage by

directing the two petitioners to appear before the court of

Principal Sessions Judge, Shopian which shall admit the

accused persons to bail subject to such terms and conditions

as may be deemed fit by the court of Principal Sessions

Judge, Shopian for ensuring that the two petitioners regularly

attend the proceedings of the criminal case so set up against

them, along with the other three undertrial accused persons in

custody, before the court of Sessions Judge, Shopian.

5. The two petitioners to report themselves before the learned

Sessions Judge, Shopian on 10th March 2026 and till that
time, the two petitioners shall not be subjected to arrest by

the Police Station Shopian.

6. In the event of failure to present themselves before the court

of Principal Sessions Judge, Shopian on due date, the

petitioners shall suffer loss of indulgence of this Court

protecting them from arrest at the hands of Police Station

Shopian.
