1. The present restoration application is reported to be barred

by 182 days.

2. An application under Section 5 of the Limitation Act has been

filed for condonation of the said delay.

3. For the reasons stated in the application under Section 5 of

the Limitation Act, the same is allowed. The delay caused in filing

the present restoration application is condoned.

4. The present restoration application has been filed aggrieved

of order dated 02.05.2025 passed by the Deputy Registrar

(Judicial) whereby S.B. Civil First Appeal No.281/2022 stood

dismissed for non compliance of order dated 18.02.2025 passed

by the Court.

5. Counsel for the petitioner submits that inadvertently, the

order could not be complied with. He submits that if the first

appeal is not restored, the sale deed of the land in question which

was executed without permission of the State Government qua a

land near border area, would again come into effect.

6. In view of the submission made, the present restoration

application is allowed at a cost of Rs.2,000/-, to be deposited to

the Litigants’ Welfare Fund within a period of one month.

7. Let S.B. Civil First Appeal No.281/2022 be restored to its

original number. The restoration of the appeal shall remain subject

to deposition of the cost.
