The Court: 1. Although the learned advocate representing the
respondent nos. 7 and 8 are yet to comply with the direction dated 12 th
February 2026, however, today the learned advocate for the municipality
has placed before this Court the report dated 20 th November 2025 and
would submit that the private respondents had been carrying on illegal
construction at the premises no.17/1, Muzaffar Ahamed Street, Ward
No.61, Borough – VI, Kolkata. According to such report, upon detecting
the unauthorised construction having taken place, a stop work notice
under section 401 of the Kolkata Municipal Act, 1980 (hereinafter
referred to as “the said Act”) had been issued on 20 th July 2023 and an
intimation thereof was also forwarded to the local police station. Since
the unauthorised construction continued defying the stop work notice,
an FIR was lodged under section 401(A) of the said Act against the
person responsible to prevent further unauthorised construction.
