1. Learned counsel for the petitioners, after arguing at some

length, upon instructions from his clients, submits that due to an

unforeseen and bona fide inadvertance, the present revision

petition has been filed under Section 115 of CPC instead of a writ

petition under Article 227 of Constitution of India, therefore, he

seeks permission to withdraw the present revision petition with

liberty to challenge the impugned order by filing a writ petition

under Article 227 of the Constitution of India.

2. Permission sought for is granted.

3. Accordingly, the present civil revision petition is dismissed as

withdrawn with the aforesaid liberty.

4. All pending application(s), if any, shall stand disposed of.

5. Further, the Registry is directed to return the Vakalatnama

and certified copy of the impugned order to the learned counsel

for the petitioners, after retaining a photocopy of the same on

record.
