By way of filing present misc. petition under Section
528 BNSS petitioner seeks to challenge order dated
10.12.2024 passed by learned Additional Chief Judicial Magistrate
(PCPNDT), Bikaner, in Criminal Case No.(650) 933/2015, whereby
the petitioner has been declared absconder and proceedings under
Section 82-83 and 446 Cr. P.C., have been initiated against him.
This Court has considered the arguments raised by learned
counsel for the petitioner and has perused the order dated
10.12.2024.
Counsel submits that the petitioner was not informed by his
counsel of the next date of hearing and he was assured earlier
that whenever his presence would be required, he would be
informed. Further, the petitioner is not a resident of Bikaner and is

residing at Jaisalmer. The compromise was also entered into
between the accused and the victim.
