Heard Mr. P. Das, learned counsel for the petitioner. Also heard Mr. K. Gogoi,
learned CGC for the respondents.
2. In this petition, under Article 227 of the Constitution of India, the
petitioner has challenged the judgment and order dated 12.02.2026, passed by
the learned Additional District Judge No. 2, Kamrup(M), at Guwahati, in Misc.
Appeal (Civil) No. 25/2022.
3. It is to be noted here that vide judgment and order dated 12.02.2026, the
learned Additional District Judge No. 2, Kamrup(M), at Guwahati has affirmed
the eviction order dated 17.02.2021, passed by the Estate Officer, N.F. Railway,
Guwahati, in Eviction Case No. EO/MLG/139/2020.
4. Perused the petition and the documents placed on record, and also
perused the impugned judgment and order dated 12.02.2026, passed by the
learned Additional District Judge No. 2, Kamrup(M), at Guwahati, in Misc. Appeal
(Civil) No. 25/2022, and the eviction order dated 17.02.2021, passed by the
Estate Officer, N.F. Railway, Guwahati, in Eviction Case No. EO/MLG/139/2020.
5. Let notice be issued to the respondents, returnable on 24.02.2026.
6. As Mr. Gogoi, learned CGC appears and accepts notice on behalf of the
respondents, no formal notice is required to be issued to them. However, extra
requisite copies of the petition be furnished to Mr. Gogoi, during the course of
the day.
7. Arguments of learned counsel for both the parties have been heard.

8. List the matter on 24.02.2026.
9. Till then, the eviction order dated 17.02.2021, shall not be given effect to.
