Heard Dr. P. Agarwal, learned Legal Aid Counsel for the petitioner.

2. In this petition, under Section 24 of the CPC, the petitioner has prayed for
transferring the F.C. (Civil) Case No. 472/2025, from the court of learned
Principal Judge, Family Court, Cachar at Silchar, to the court of learned District
Judge, Sribhumi.

3. Dr. Agarwal, learned Legal Aid Counsel for the petitioner submits that the

petitioner is the wife of the respondent, who had instituted the F.C. (Civil) Case
No. 472/2025 before the court of learned Principal Judge, Family Court, Cachar
at Silchar.

3.1. Dr. Agarwal further submits that the petitioner is presently residing at her
parental house, situated at Sribhumi and that from Sribhumi to Cachar, though
the distance can be covered within a period of one hour, yet to reach the court,
which is situated at such a place that it takes about four hours.

3.2. Dr. Agarwal also submits that the petitioner has an ailing baby of only one
year old, who had undergone two surgical operations for intestinal problem and
that it would practicably become impossible for her with the baby to undertake
the journey from Sribhumi to Cachar at Silchar, to contest the F.C. (Civil) Case
No. 472/2025.

3.3. Dr. Agarwal also submits that this present petition is filed with the help of
Legal Aid and she is engaged by Legal Services Authority and that one more
proceeding, under Section 125 of the CPC, being Misc. Case No. 84/2025, is
pending before the court of learned Sub-Divisional Judicial Magistrate, Sribhumi
and the said case was also filed through the District Legal Services Authority.
Under such circumstances, Dr. Agarwal has contended to transfer the F.C. (Civil)
Case No. 472/2025 from the court of learned Principal Judge, Family Court,
Cachar at Silchar, to the court of learned District Judge, Sribhumi.

4. The submission of Dr. Agarwal, learned Legal Aid Counsel for the
petitioner, needs further consideration.

5. At this stage, let notice be issued to the respondent, within a week from
today, by speed post with A/D and also by usual process, returnable in 4 weeks.

6. List the matter after 4 (four) weeks.

7. Till returnable date, further proceeding of F.C. (Civil) Case No. 472/2025,
pending before the court of learned Principal Judge, Family Court, Cachar at
Silchar, stands stayed.
