The Police Inspector of Madivala Traffic Police
Station has filed charge sheet against the accused for the
offence punishable U/Sec.279, 304(A) of IPC, Sec.185,
Sec.3(1) R/w Sec.181 and Sec.129 R/w Sec.194(D) of
IMV Act.
2. The brief facts of the prosecution case are as
under: –
That on 14.09.2023 at 1.15 a.m. accused being
the rider of two wheeler bearing registration No.KA-05-
KP-0292 rode the same by consuming alcohol and
without wearing helmet along with pillion rider
Kum.Deepa within the jurisdiction of Madivala Traffic
Police station on Hosuru Main Road from St. John
hospital junction towards Silk Board in a rash and
negligent manner so as to endanger human life and
himself hit to Madivala underpass wall, as a result both
fell down and pillion rider Kum.Deepa sustained

grievous injuries and while taking treatment at Lakshmi
Global hospital she succumbed to injuries on the same
day at 3.19 a.m. Further, at the time of accident accused
was not wearing helmet and he did not have driving
licence to drive the offending vehicle. Thereby, the
accused has committed an offence punishable
U/Sec.279, 304(A) of IPC, Sec.185, Sec.3(1) R/w Sec.181
and Sec.129 R/w Sec.194(D) of IMV Act.
