In Re: An Application for Bail under Section 483 of the Bharatiya
Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of
Criminal Procedure, 1973 in connection with Hogalberia Police
Station Case No. 96/2023 dated 01.05.2023 under section
353/186/188/189 of the Indian Penal Code and section 14(A) of
the Foreigners Act.

Learned advocate appearing for the petitioner submits
that petitioner is in custody for 1 year and 5 months and is
similarly placed as the accused who has been granted bail in
CRM (NDPS) 1468 of 2024. It has also been pointed out that
the subject matter of the present case relates to recovery of 45
bottles of Phensedyl and 16 Kgs. of Ganja. There has been no
recovery from the present petitioner.
Learned advocate for the State opposes the prayer for
bail but is unable to refute such contention that no substance
being recovered from the present petitioner. However, learned
advocate for the State reiterates regarding certain antecedents
of the present petitioner.

I have taken into account the period of detention
including the overall circumstances so far as the present case
is concerned. Having regard to the same, I am of the view that
the petitioner be released on bail.
Accordingly, the prayer for bail of the petitioner is
allowed.
Accordingly, Petitioner, namely, Suman Mandal @
Mondal shall furnish bond of Rs. 20,000/- (Rupees Twenty
Thousand Only) with two sureties of Rs. 10,000/- (Rupees Ten
Thousand Only) each. One of whom must be local to the
satisfaction of Learned Judge, Special Court under NDPS Act,
Krishnanagar, Nadia.
If on bail petitioner shall be physically present on each
and every date fixed by the learned Trial Court and shall not
leave the jurisdiction of District of Nadia without the prior
permission of the learned Special Court.
Accordingly, CRM (NDPS) 173 of 2026 is allowed.
All parties shall act in terms of server copy of the order
downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied
for, be supplied to the parties upon compliance with all
requisite formalities.
