BEFORE
HON’BLE THE CHIEF JUSTICE MR. M. SUNDAR
(ORDER)

18.02.2026

[1] Read this in conjunction with and in continuation of earlier

proceedings, more particularly, the proceedings/order made on 09.12.2025 which

reads as follows:

‘09.12.2025

[1] Read this in conjunction with and in continuation of earlier

proceedings/order made in the previous listing on 03.12.2025 which

reads as follows:

‘03.12.2025
[1] This order/proceedings should be read in conjunction with and in
continuation of earlier proceedings made in the previous listing on
01.12.2025 and a scanned reproduction of the same is as follows:

[2] The afore-referred 01.12.2025 proceedings/order shall
now be read as an integral part and parcel of the instant

order/proceeding. This inter-alia means that, short forms, short
references and abbreviations used in 01.12.2025 proceedings shall
continue to be used in the instant proceedings/order also.

[3] Today Ms. G. Pushpa, along with Ms. Th. Ranjeeta,
learned counsel for revision petitioner, is before this Court. To be noted,
revision petitioner Mrs. Tongbram Ongbi Rashirani Devi is also present in
Court with her.

[4] Adverting to earlier proceedings, learned counsel for
petitioner, submits that a sum of Rs. 8.2 Lakhs has since been deposited
in Court to the credit of the captioned CRP to show the bonfaides of
revision petitioner. The papers of the Registry in this regards are before
this Court.

[5] Learned counsel expressed regret for writing in the cover
letter qua afore referred deposit that deposit is being made in compliance
of the Court’s order. Learned counsel submits that deposit has been
made voluntarily by the revision petitioner, on her on own volition to
show her bonafides. This submission made on instructions from the
revision petitioner who is present in Court is recorded.

[6] As regards the said Family Court, a report together with
the case record has been sent and the same has been placed before this
Court in a sealed envelope. This Court had the benefit of perusing the
report of the Presiding Officer as well as the case records.

[7] Learned counsel for revision petitioner on instructions
submits that the money receipt and other papers qua said Family Court
records were signed by revision petitioner without knowing the contents
as the contents were neither explained to her nor was she permitted to
read the contents. This includes the money receipt is learned counsel’s
say. Learned counsel also submits that revision petitioner was not in
Imphal on 12.09.2025 which is the date of the money receipt and that
the money was paid to revision petitioner’s father (not to revision
petitioner) is her further say.

[8] Be that as it may, on a careful perusal of the case records,
it comes to light that there is overwriting in pen (overwriting qua typed
matter) in the case number as well as the date of deposition of the
revision petitioner who is said to have deposed as CW2. To be noted,
such overwriting is not there in the deposition of husband who deposed
as CW1 and more importantly while deposition of CW1 has been signed
by husband, there is no signature of the revision petitioner in the
deposition of CW2 and the overwriting with regard to the date appears
Page 4 of 8

to be date typed as ’17th day of September’ has been altered as ’18th day
of September’ in pen. A scanned reproduction of the same is as follows:

[9] It was also pointed out that the impugned order of said
Family Court says that revision petitioner is serving as Constable in SSB
and she has now been posted in Delhi (To be noted expansion of SSB
has not been given). In this regard it is further submitted that revision
petitioner is a graduate in nursing, she has worked as a nurse in a
hospital in Bangalore as a Nurse but has never served as Constable. It is
emphasized that there is no pleading in this regard, even purported
deposition does not record so.

[10] In the light of the narrative thus far, revision petitioner
has prima facie shown her bonafides and prima facie case has been made
out.

[11] Issue notice to all 4(four) respondents, returnable by
Tuesday i.e., 09.12.2025. Private/dasti notice permitted.

[12] A reproduction of the prayers in the captioned
Miscellaneous Case is as follows:

[13] If the husband contracts another marriage pursuant to
impugned order pending revision petition an irreversible situation can
arise and irreversible legal injury can occur.

[14] Prima facie case made out. Issue notice to respondents,
returnable by 09.12.2025. Private notice/Dasti notice permitted. In the
light of possibility of irreversible legal injury, balance of convenience is in
favour of grant of interim order as sought for. Therefore, there shall be
