3. By virtue of the present application, the appellant seeks condonation
of delay of 24 days in filing of the captioned appeal.
4. Issue notice. Learned APP for the State accepts notice and submits
that he has no objection if the present application is allowed.
5. For the reasons stated therein, as also in view of the no objection
given by the learned APP for the State, the present application is allowed

7. By virtue of the present application, the appellant seeks permission

9. By virtue of the present appeal under Section 415(2) read with
Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS), the
appellant seeks setting aside of the judgment on conviction dated
31.10.2025, as also the order on sentence dated 17.11.2025, passed by
learned Additional Sessions Judge, (SC-POCSO), East District,
Karkardooma Courts, Delhi (learned Trial Court) in SC No.1062/2018
arising out of FIR No.15/2018 registered at PS.: Shakurpur, Delhi under
Sections 363/366/308/376/506 of the Indian Penal Code, 1860 (IPC) read
with Section 6 of the Protection of Children from Sexual Offences Act,
2012 (POCSO), whereby he has been found guilty of the alleged offences
and sentenced to undergo rigorous imprisonment for a period of eleven
years alongwith a fine of Rs.15,000/-, in default whereof, to undergo
simple imprisonment for a period of six months for the offences under
Section 376(2) of the IPC; to undergo rigorous imprisonment for a period
of five years alongwith a fine of Rs.10,000/- in default whereof, to
undergo simple imprisonment for a period of five months for offence
under Section 308 of the IPC; to undergo rigorous imprisonment for a
period of two years alongwith a fine of Rs.3,000/- in default whereof, to

undergo simple imprisonment for a period of three months for the offence
under Section 363 of the IPC; to undergo rigorous imprisonment for a
period of three years alongwith a fine of Rs.5,000/- in default whereof, to
undergo simple imprisonment for a period of four months for offence
under Section 366 of the IPC; to undergo rigorous imprisonment for a
period of one year alongwith a fine of Rs.2,000/- in default whereof, to
undergo simple imprisonment for a period of two months for the offence
under Section 347 of the IPC; and to undergo rigorous imprisonment for a
period of three years alongwith a fine of Rs.5,000/- in default whereof, to
undergo simple imprisonment for a period of four months for offence
under Section 506(II) of the IPC, all sentences to run concurrently.
10. For the reasons stated therein, Admit.
11. Issue notice. Learned APP for State accepts notice.
12. Let TCR be requisitioned in the digitised form from the learned
Trial Court within a period of four weeks.
13. List this appeal in due course in the category of ‘Regulars’ as per
the year of its seniority.
CRL.M.(BAIL) 365/2026 (for suspension of sentence)
14. By virtue of the present application under Section 430 read with
Section 528 of the BNSS, the appellant seeks suspension of sentence and
grant of bail during the pendency of the present appeal.
15. Learned counsel for the appellant submits that the appellant has
already undergone a substantial period of sentence out of the total
sentence awarded to him.
16. Issue notice. Learned APP for the State accepts notice. He seeks,
and is granted, a period of four weeks to file the Status Report precisely

mentioning the period of sentence already undergone by the appellant out
of the total sentence awarded to him.
17. Keeping in view the nature of the facts and disputes involved, the
parties are hereby called upon to file their respective written synopsis
instead of reply/ rejoinder not exceeding three pages, giving a
chronological list of dates and events and relevant documents, if any,
alongwith duly highlighted judgments setting out the propositions of law
therein, they wish to rely upon within two weeks prior to the next date of
hearing.
18. Let the latest Nominal Roll of the appellant be also requisitioned
from the concerned Jail Superintendent within the aforesaid period of four
weeks.
19. Since the present proceedings are under Sections 376 of the IPC, let
an intimation under Section 483(2) of the BNSS read with Delhi High
Court Practice Directions dated 24.09.2019 in form Annexure-A attached
to the Practice Directions be sent by the Investigating Officer to the
complainant/ prosecutrix/ informant informing her of the pendency of the
present matter to enable her or her authorised signatory to be present in
Court if they so desire, either through video conferencing or in Court. It is
clarified that it is not compulsory for the prosecutrix to appear in person
for the hearing.
