This is a petition filed under Section 25 of the Code of

Civil Procedure, 1908 (for short “CPC”). The petitioner is the

wife of the respondent.

The petitioner has filed this transfer petition seeking

the following reliefs:

“a. Kindly transfer Miscellaneous Case No.162 of
2024 titled as “Aman Nagpal Vs. Anshu Gera alias
Anshu Nagpal” pending before the Court of Ld.
Additional Principal Judge-I, Family Court Dehradun
to the Court of Ld. Principal Judge, Family Court,
Faridabad, Haryana; and/or

b. Pass such any other or further order/orders as
this Hon’ble Court may deem fit and proper in the
facts and circumstances of the case.

We have heard learned senior counsel for the

petitioner/wife and Ms. Radhika Gautam, learned Amicus Curiae

for the respondent.

learned Amicus Curiae for the respondent and on perusal of the

case for transfer of the aforesaid petition.

In the result, the transfer petition is allowed and

Miscellaneous Case No.162 of 2024 pending before the Court of

Additional Principal Judge-I, Family Court, Dehradun is ordered

to be transferred to the Court of Principal Judge, Family

Court, Faridabad, Haryana and shall be connected with CNR

No.HRFB010057052025 which is a case filed under Section 125 of

the CrPC by the petitioner/wife pending before the Court of

the Addl. Principal Judge, Family Court, Faridabad, Haryana.

Further, liberty is reserved to the respondent to appear

before the Court in the aforesaid matter either in person or

through video conferencing facility. If such a request is

made, the Court shall make available video conferencing

facility to the respondent herein.

We place on record our sincere appreciation of the

services rendered by Ms. Radhika Gautam, learned counsel as

Amicus Curiae for the respondent.

Registry to communicate this order to the transferor as

well as the transferee courts for taking steps in accordance

with this order.
