The present complaint is filed under section 200 of
code of criminal procedure against the accused seeking to
punish him for the offence punishable under section 138
of the Negotiable Instruments Act ( in short referred as “N.I.
Act”).
02. The factual backgrounds of the complaint are as
under.
It is stated that, the accused was running business
in the name and style as Sankalana Chits Pvt. Ltd. Under
the license situated at Hesaraghatta Main Road, Bangalore.
In the year 2018 accused conducted a chit transaction for
a sum of Rs.10,50,000/- and on the request of accused he
took one of membership on 12.07.2018 as ticket No.15 for
vlaue of Rs. 10 lakhs for a period of 30 months,
commencement from 12.07.2018 and with monthly
subscription for Rs.35,000/- as per the terms and
conditions. It is further stated that, the Complainant in
all has paid total 25 installments and having receipt for the
said installment amount the accused has issued receipts.
The Complainant did not took the chit amount and also he
never contested auctioned bid, accordingly the accused has
a balance of Rs.8 lakhs chit amount to the Complainant .
However, the accused closed the chit company without
informing to the chit members and has shifted the same to
other place. It is contended that, the Complainant given
complaint against the accused before the Bagalagunte PS
on 25.06.2021 and filed registered NCR No.348/2021.
Later on the repeated demand and request made by the
the Complainant , the accused has isued the following
cheques.
