1. Heard.
2. Having gone through the record and after hearing the
learned counsel for the petitioners, it is evident that after
sanction was granted, the construction was made and
according to the petitioners without hearing the
petitioners, the sanction was revoked and cancelled.
Against such cancellation, the petitioners approached in
appeal, wherein the sanction was restored after setting aside
the order of cancellation of the sanction order.
3. Thereafter, the notice under Section 54 of the
Maharashtra Regional Town Planing Act, 1966 which is
impugned in the present petition.
4. It is submitted that yesterday i.e. on 13.02.2026, the
squad of the respondent Nos.3 to 7-Corporation came on
the spot and started to demolish the construction work,

which is contrary to the law.
5. On the other hand, Mr. Kasat, learned counsel for
respondent/Corporation submits that the facts stated by the
learned cousnel for the petitioners are not the correct facts
and he would bring on record the complete and correct
facts along with reply on next date.
6. In the circumstances, issue notice to the respondents,
returnable on 18.02.2026.
7. The learned AGP waives service of notice for the
respondent/State.
8. Mr. Kasat, learned counsel, waives service of notice
for the respondent/NMC.
9. Considering the record and the submission made by
the learned counsel for the petitioners, both the parties are
directed to maintain status quo as on today, in respect of
the building/construction in question, till next date.
10. An authenticated copy of this order be given to the
parties.
11. Office objections(s), if any, shall be removed before
the next date.
