1. The defendant has filed an application being G.A. No. 2 of 2022 in C.S.
(Com) No. 593 of 2024 (Old No. C.S. 165 of 2021) for dismissal of suit
for the reasons that:
a. The plaintiff has not applied specific
performance of the entirety of the said
Development Agreement dated 17th August,
2015.
b. In view of the bar under Section 12 of the
Specific Relief Act, 1963 (as amended),
specific performance of a part of the contract
cannot be directed and the Court shall not
direct the specific performance of a part of the
contract, as prayed for.
