The Oriental Insurance Co.Ltd vs Jobin.T.S on 31 July, 2025


This appeal has been filed under Section 173 of the

Motor Vehicles Act, 1988 (the Act) by the third

respondent/insurer in O.P.(MV) No.303/2017 on the file of the

Motor Accidents Claims Tribunal, Taliparamba (the Tribunal),

aggrieved by Award dated 31/08/2019. The respondent herein is

the claim petitioner in the petition. In this appeal, the parties and

the documents will be referred to as described in the original

petition.

2. According to the claim petitioner, on

28/08/2016 at 09:15 a.m., while he was riding motorcycle bearing

registration no.KL-59-K-3936 from Karuvanchal to Oduvally and

when reached near Chanokundu bridge, bus bearing registration

no.KL-58-M-9906 driven by the first respondent in a rash and

negligent manner knocked him down, as a result of which he

sustained grievous injuries.
