                                                       ORDER

1. Heard learned counsel for the parties.

2. The present transfer petition has been filed by

the petitioner-wife seeking transfer of the divorce

petition initiated at the instance of the

respondent bearing Family Suit No.18 of 2024,

titled as “Mayurraj Balkrishana Sharma Vs. Kamini

Mayurraj Sharma”, pending before the Family Court,

Dahod, Gujarat to the Family Court, Jodhpur,

Rajasthan.

3. During the pendency of the present petition,

with the consent of the parties, the matter was

referred to the Rajasthan High Court Mediation

4. The parties have settled the dispute under the

Settlement which is reflected from the report of

the learned Mediator. The report states that the

parties have agreed to live separately and that a

decree of divorce be passed with mutual consent.

5. The respondent-husband has agreed to pay a sum

of Rs.30,00,000/- to the respondent-wife;

Rs.20,00,000/- in the name of the daughter and

Rs.10,00,000/- in favour of the petitioner-wife.

6. The respondent-husband is present in Court and

has brought two demand drafts (i) Rs.20,00,000/- in

the name of the daughter and (ii) Rs.10,00,000/- in

the name of the petitioner-wife who is also present

in Court. These demand drafts have been handed over

to the petitioner-wife.

7. It has also been agreed that all cases pending

between the parties shall stand closed namely, FIR

No.137 of 2024 registered at Police Station-Jodhpur

City West under Sections 498-A, 406 and 323 of the

Indian Penal Code; and Criminal Case No.251 of

2024, under Section 144 of the Bharatiya Nagarik

Suraksha Sanhita, 2023, before the Family Court

No.1, Jodhpur titled as Smt. Kamini Sharma vs.

Mayurraj Sharma, both filed by the petitioner.

8. Learned counsel for the petitioner submits that

one another case between the parties under the

provisions of D.V. Act filed by the petitioner,

shall be withdrawn by her.

9. In terms of the aforesaid settlement, an

application bearing I.A. No.149153 of 2025 seeking

dissolution of marriage between the parties by a

decree of divorce on the basis of mutual consent

has been filed under Article 142 of the

Constitution of India.

10. Considering the fact that the marriage has

been irretrievably broken down and the parties have

agreed to live separately, we consider it proper to

exercise our power under Article 142 of the

Constitution of India and direct for drawing a

decree of divorce by mutual consent in the Divorce

Case-Family Suit No.18 of 2024, titled as “Mayurraj

Balkrishana Sharma Vs. Kamini Mayurraj Sharma”,

pending before the Family Court, Dahod, Gujarat

which shall stands closed accordingly.

11. Similarly, all other cases referred to above

shall also stand closed.

12. The application being I.A. No.149153 of 2025

is allowed in the above terms and the transfer

petition stands disposed of accordingly.

13. The Registry shall inform the respective

Courts about this order where the proceedings are

pending in the aforesaid cases stand closed.
