This application for bail under Section 483 of BNSS (439

Cr.P.C.) has been filed by the petitioners who have been arrested

in connection with F.I.R. No.107/2025 registered at Police Station

Mandor, District Jodhpur City East, for offences under Sections 78,

294(2)(A), 316(2) of the BNS and Section 67, 67(A), 67(B) of the

Information Technology Act and Section 14, 15 and 17 of the

POCSO Act.

Heard learned counsel for the petitioners and learned Public

Prosecutor. Perused the material available on record.

Learned counsel for the petitioners submits that the

petitioners are students aged about 22 and 19 years old

respectively. As per the prosecution’s story, allegations against the

present petitioners are that they shared links of objectionable

content online with others. Learned counsel submits that the

petitioners have no criminal antecedents and charge sheet has

already been filed in this matter. Learned counsel submits that the

petitioners are in custody since 07.05.2025. and the trial of the

case will take sufficiently long time, therefore, the benefit of bail

may be granted to the accused-petitioners.

Per contra, learned Public Prosecutor has vehemently

opposed the bail application; however, he is not in a position to

refute the fact that challan has already been filed in this matter.

Having considered the rival submissions, facts and

circumstances of the case; considering that petitioners are

students aged 22 and 19 years old; without expressing any

opinion on merits/demerits of the case, this Court is inclined to

enlarge the petitioners on bail.

Consequently, the bail application under Section 483 of BNSS

(439 Cr.P.C.) is allowed. It is ordered that the accused-petitioners

(1) Amit S/o Dileep and (2) Sumit S/o Dileep, arrested in

connection with F.I.R. No.107/2025 registered at Police Station

Mandor, District Jodhpur City East, shall be released on bail, if not

wanted in any other case, provided they furnishes a personal bond

of Rs.50,000/- and two sureties of Rs.25,000/- each, to the

satisfaction of learned trial court, for their appearance before that

court on each & every date of hearing and whenever called upon

to do so till completion of the trial.
