1. The Detailed Accident Report (hereinafter referred as DAR)
was filed in this case on 25.08.2022, with reference to FIR No. 0366-22,
U/s 279/338 IPC & 184 MV Act, PS DBG Road, Delhi, in respect of
grievous injuries, sustained by the petitioner Meenakshi, in a road
accident, on 16.05.2022, at about 09.00 pm at Kalkadas Chowk Red
Light Karol Bagh ND. Subsequently, chargesheet was filed by the IO,
against Adil Khan S/o Sh. Naushad Khan (hereinafter referred as
Respondent no.1/R1/driver), for the alleged commission of offence U/s
279/338 IPC. The Ld. Predecessor of this Tribunal, vide order dated
30.08.2022, treated the DAR as claim petition U/s 166(4) of the Motor
Vehicles Act, 1988 (hereinafter referred to as ‘M.V.Act’)
