1. The Court is rendering this judgment in response to the suit
filed by Sh. Harpreet Singh and Sh. Lakshya Jeet Singh
(hereinafter to be referred to as ‘plaintiffs’) for seeking the
relief of Possession, Damages and Permanent Injunction with
regards to the property bearing flat no. D-45, Double Story,
Malka Ganj, Delhi-110007 measuring approx. 254 sq. feet
(hereinafter to be referred to as ‘suit property’) against Sh.
Manmohan Singh and Sh. Upinder Jit Singh (hereinafter to be
referred to as ‘defendants’).
Facts pleaded in plaint (In Brief)
2. It is the case of the plaintiff that the grandfather of the
plaintiffs, namely Late Ram Singh, was the original allottee of
the suit property which was allotted by the Govt. of India
Department of Rehabilitation, and he died on 01.12.1990;
though, before his death, he had executed a registered Will in
favour of his daughter-in-law, Smt. Balbir Kaur, i.e., the
mother of the plaintiffs, on 26.08.1985. It has also been
averred that on 20.11.2011, Smt Balbir Kaur expired, leaving
behind her husband, Surjeet Singh, and two sons, Harpreet
Singh and Sh. Lakshya Jeet Singh, and thereafter, on
13.06.2013, Sh. Surjeet Singh relinquished all his rights, title
and interest in respect of his share in the suit property in
favour of his two sons by way of relinquishment deed.
