In a significant trademark rectification case, the Delhi High Court has upheld the rights of Ganesh Consumer Products Limited, previously known as Ganesh Grains Limited, over the trademark “GANESH” for food products.

The Court’s decision was delivered in a rectification petition filed by the company against Dharmendra Kumar Gupta’s trademark registration for the device mark “GANESH HARA MATAR” in relation to similar food products.

Ganesh Consumer Products successfully established its longstanding use of the trademark “GANESH” since 1936, demonstrating its extensive reputation in the food industry.

The company argued that the similarity of the disputed marks, both in appearance and application to food products, would likely cause consumer confusion and infringe upon its established trademark rights.

Recognizing these rights, the Delhi High Court directed the cancellation of the counterparty’s registration for “GANESH HARA MATAR” to prevent potential consumer deception and protect the exclusivity of the “GANESH” mark.

The legal team representing Ganesh Consumer Products Limited included Ankur Sangal, Partner at Khaitan & Co., along with Pragya Mishra, Principal Associate, and Amrit Sharma, Associate, who successfully argued the case on behalf of the company.
