2. Mr. B.C. Joshi, learned A.G.A. for the State of
Uttarakhand.
3. By means of the present C528 application,
applicant has challenged the entire proceedings of
impugned order dated 21.01.2025, passed by learned
Judicial Magistrate, Second Division, Haridwar in
Miscellaneous Case No. 25 of 2023, under Sections 323,
504, 506, 498A and 406 of the Indian Penal Code, 1860
and under Section 3/4 of the Dowry Prohibition Act,
1961, “Smt. Sundari alias Tannu vs. Vikas Chauhan”.
4. In view of the matter, this Court is of the opinion
that the presence of respondent no. 2 is required.
5. Issue notice to respondent no. 2.
6. Steps to be taken within a week.
7. List this case on 25.07.2025.
8. Counter affidavit, if any, may be filed.
9. Till the next date of listing, the proceedings of
Misc. Case No. 25 of 2023, “Smt. Sundari alias Tannu
vs. Vikas Chauhan” under Sections 323, 504, 506, 498A
and 406 of the Indian Penal Code, 1860 and under
Section 3/4 of the Dowry Prohibition Act, 1961, pending
in the Court of learned Judicial Magistrate, IInd
Haridwar, shall remain stayed.
10. Stay Application (IA No. 01 of 2025) is disposed
of accordingly.
