 COMMON ORDER:

since these criminal Petitions are filed, under Section 482 of

BNSS, seeking to grant anticipatOry bail, by the Petitioners herein in

same crime viz. crime No.209 of 2024 of Tadipa{hri Town -Police

station, Ananthapuram District, registered for the OffenCeS Punishable

under sections 147, 148, 188, 506, 323 and 307 read with 149 lPC,

they are being taken up together for disposal by way of this Common

Order.

2, Case of the prosecution, in brief, iS that On 14.05.2024, atabout

5:00 p.m., at college ground J.C.Asmith Reddy House, Tadipatri town,

all ,the accused criminally assembled unlawfully, armed With deadly

weapons, and began hurling stones and sticks. During the incident, the
I defacto complainant sustained dumb injury over his body. Due to

political rivalry with the ysRCP leaders, the defaCtO COmPIainant feared

for his safety and, as a result, did not report the matter to the police

‘station directly. Instead, he sent a report through registered post.

3. Heard learned counsel for the Petitioners and the learned

Assistant Public Prosecutor representing the .respondent/State.

4. . A perusal of the material on record goes to ,show that’the

incident in question is said to have occurred on.14.05.2024 and the

petitioners herein belonged ®to two leading political parties- one, the

then ruling party, the other, the then opposition party. The incident in

question said to have taken place in connection with Assembly and

Parliament Elections held on 14.05.2024. ln the present crime, the

investigation officer has recorded the statements of material witnesses.

As seen from the record, the crime was registered on 09.10.2024 and

some of the victims have sent their grievances through registered post

to the S.H.O. who registered three separate crimes. It appears that

based on the same incident different crimes have been registered.

However, learned Assistant Public Prosecutor submits that the victims

are totally different. ln the said facts of the case, the incident in

question took place long back and therefore, this Court finds that best

part of investigation is over and any custodial interrogation does not

Seem necessary.

5. Learned counsel for, the petitioners submits that the petitioners

had permanent abode and there is no possibility of their fleeing away

from the justice and most of the petitioners are the breadwinners of

their families.

6. lt is evident from the record that this court has already granted

interim protection to the petitioners, directing the state not to take any

coercive steps against them, and the said order has been in force until

today. lt is not the ‘case of the prosecution that the petitioners have

v]’olated any of the conditions imposed by the court

7`.I ln view of the aforesaid facts and circumstances of{he case, this

court finds that most of the investigation might have been completed

by this time and granting of anticipatory bail to the petitioners may not

adversely affect the prosecutionjs case and herice, this court is

inclined to grant anticipatory bail to the petitioners herein, however, on

conditions.

8. Accordingly, in the even-t of their arrest in the above saI’d Crime,

the petitioners herein shall be released on bail on executing a personal

bond for a sum of Rs.20,000/- (Rupees twenty thousand only) each

with two sureties each for the ‘Iike sum to the satisfaction of the

arresting police officials and also on condition that the petitioners shall

make the’mselves available for lnvestiga-lion Officer as and when

required and that they shall not cause any threat, inducement or

promise to the prosecution witnesses. .

9. Accordingly, the Criminal Petition Nos.7246, 7444, 7452 and

7454 of 2024 are allowed.
