06/ 07.05.2025: Heard, learned counsel for the petitioner and learned counsel
for the State.
2. The present anticipatory bail application under sections 482 and 484
of the BNSS, 2023, has been preferred by the petitioner apprehending his
arrest for the offence registered under sections 452, 386, 387, 504, 506/34
of I.P.C. and sections 25(1-B)a/26/35 of the Arms Act, in connection with
Dumka (M) P.S. Case No. 49 of 2024 pending in the court of learned C.J.M.,
Dumka.
3. It has been alleged by the informant that on 11.05.2024, two persons,
one Vipin Yadav and other unknown, came to his house in the night, on a
black colour Hero Honda Splender Motorcycle. They entered his house,
one having a revolver in his hand and while abusing the informant,
demanded Rs. 5,00,000/- and threatened to kill him if not given. The
villagers caught hold of Vipin Yadav and the other person ran away. The
police was called and the revolver, mobile and motorcycle recovered from
Vipin Yadav was handed over to the police in front of the people.
4. Learned counsel for the petitioner submitted that the petitioner, on
11.05.2024, was hit by a Scorpio vehicle and the accused persons brutally
assaulted and abducted the petitioner. They took him to the house of
Shisupal Rout (informant) and Thaku Rout, where the petitioner was
tortured and beaten in the head and shoulder. Later, the petitioner was

handed over to the police station Dumka (M) under the false charge of
extortion of money and attempt to murder. It was actually the earned
money of the petitioner that Theku Rout and Shisupal Rout had kept with
themselves for last eight months and were not giving it back. On
13.05.2024, due to serious injury and the pressure of the occurrence video
getting viral, the petitioner was released. The wife of the petitioner lodged
an F.I.R. against the 7 accused persons on 19.05.2024. Learned counsel
submitted that from the video of occurrence it is clear that the allegation
against the petitioner is false.
5. Learned APP has opposed the prayer for anticipatory bail and
submitted that the co-accused has accepted his guilt and stated the name
of the petitioner in the alleged occurrence, as is mentioned in the
paragraph no. 44 of the case diary. The petitioner has 6 criminal
antecedents and there are sufficient materials available against the
petitioner.
6. Considering the fact that there is direct allegation against the
petitioner and also he had criminal antecedents, I do not find it to be a fit
case for granting anticipatory bail.
7. Accordingly, this anticipatory bail application is dismissed.
8. Pending I.A, if any, stands disposed of.
