The Court :- Mr. Chatterjee, Learned Advocate appearing for the
respondents submits, on instructions, that in view of the judgment and order
dated January 27, 2026 passed by Hon’ble Division Bench of this Court in MAT
1933 of 2025, the respondents are not taking any step for creating any third
party rights in respect of the property which form subject matter of the Will. In
view of such fair stand, no explicit order of injunction is being passed presently.
As prayed for, let affidavit-in-opposition to the application be filed within
ten days from date. Reply thereto, if any, be filed within seven days thereafter.

affidavits.
The point of maintainability taken by Mr. Chatterjee is kept open.
