Common Order
Upon considering the nature of allegations, this is the case coming within
the broad contours of the exercise of power to quash the cases on compromise,
as laid down by the Hon’ble Supreme Court of India in Gian Singh -Vs- State
of Punjab and Another (2012 10 SCC 303). In view thereof, I am of the view
that this is a fit case to attempt mediation. When the matter is listed, there is no
objection on either side for referring the matter for mediation.
1. The Police Concerned shall inform the parties, the defacto complainant and
the accused about the place and time of mediation, apart from the learned
counsel.
2. Wherever possible, the parties can participate in the mediation in person.
The mediator may also conduct the mediation online through any portal or
via Whatsapp video calls. If the parties are out of station or working
elsewhere, as far as possible, the mediation should be conducted virtually. It

can also be conducted in a hybrid mode, where some of the parties appear in
person and others virtually.
3. If an agreement is reached and the parties are unable to come to the
mediation centre to sign, the consent of the de facto complainant/accused
for quashing the complaint on compromise can also be obtained through
video recording, and the same shall be produced before the Court along
with the report of the mediator. This procedure is followed specifically and
only for these types of cases.
4. It is made clear that, apart from the case that is referred, it would be open to
the parties to discuss all issues between them, and if any civil suit is
pending, the Mediated Settlement Agreement will also be forwarded to the
concerned court and a decree will be passed in terms of the Mediated
Settlement Agreement.
5. The case is referred for mediation to the Chairman, District Mediation
Centre, Cuddalore.
6. The first date of mediation will be on 13.08.2026 at 03:30 p.m.

7. Even though, normally, 60 days time will be given to mediate, in this case,
attempt for mediation as quickly as possible and send a report to this Court
by 18.09.2026.
Call the case on 18.09.2026, after receipt of a report from the Mediator.
