While the claim of the petitioner to have the right and title to the land,
which had been earmarked as ‘Community Hall’ in the approved layout plan,
from the hands of the layout promoter, viz., VGP Housing Pvt. Ltd. which stood
negatived at the hands of the 2nd respondent is put to test before this Court in
W.P. No.27479/2017, W.P. No.10369/2017 has been filed to prohibit the layout
promoter from putting up any form of construction and/or altering/remodelling
the existing construction in any manner whatsoever including for a
restaurant/showroom/commercial purpose or for any other purpose and to hand
over the Community Hall and the land appurtenant thereto to the petitioner
herein for the exclusive and beneficial use of the petitioner association and its
members/owners/occupants of the plots in the layout in accordance with the
proceedings bearing Ref.LDPM/DDTP No.151/1974.
