1. Leave granted.
2. This appeal arises out of the quash petition in Application
U/S 528 BNSS No. 15429/2025 filed before the High Court of
Judicature at Allahabad by Praveen Kumar Sharma and Sushma,
respondent Nos. 1 and 2 herein, the father-in-law and the
mother-in-law of the appellant, Divya Sharma.
3. By order dated 19.08.2025 passed therein, a learned Judge of
the High Court stayed further proceedings in Criminal Case
No. 71/IX of 2025, titled “State of U.P. vs. Sidhant Sharma &
Ors.”, arising out of First Information Report (FIR) No.
54/2024 dated 07.04.2024 registered by the appellant, Divya

Reason:
504, 506, 354B, 377 and 511 of the Indian Penal Code, 1860,

read with Sections 3 and 4 of the Dowry Prohibition Act,1961. The accused named therein were the husband of the
appellant, Sidhant Sharma, along with his parents, Praveen
Kumar Sharma and Sushma, and other family members.
4. Aggrieved by the stay granted by the High Court, the
appellant approached this Court. She also filed I.A. No.
287280/2025 before this Court seeking to implead her husband,
Sidhant Sharma, as respondent No. 4. The application was
ordered on 14.11.2025 and notice was issued in the matter in
view of the statement made on behalf of the appellant that
she was interested in settling the matter through mediation,
if possible. Notice having been served, the respondents
entered appearance through counsel and expressed their
willingness to explore the possibility of settlement through
mediation. The matter was, accordingly, referred to the
Supreme Court Mediation Centre on 03.02.2026. Pursuant to the
efforts made by the learned Mediator, the parties settled
their disputes and reduced the terms of their compromise to
writing, vide Settlement Agreement dated 20.07.2026. Based
thereon, they filed a joint application in I.A. No.
214817/2026 seeking appropriate directions from this Court.
5. The matter was taken up for hearing today and the appellant,
Divya Sharma, along with respondent Nos. 1 and 2, viz.
Praveen Kumar Sharma and Sushma, were present in person
before the Court. Sidhant Sharma, respondent No. 4, who is
stationed in Australia presently, appeared online. All of

them jointly stated that they voluntarily executed the
aforestated Settlement Agreement dated 20.07.2026. We may
note that the signatures of Sidhant Sharma were affixed on
the Settlement Agreement in the presence of a Notary Public
at Brisbane, Australia.
6. We find that the marriage between the appellant, Divya
Sharma, and respondent No. 4, Sidhant Sharma, was solemnized
on 21.01.2024. The Settlement Agreement records that the
marriage was never consummated. The couple is stated to have
separated on 05.03.2024 itself and they have been living
apart since then. There is, therefore, no possibility of any
reconciliation at this stage.
7. The Settlement Agreement records that the couple is in
agreement that their marriage has irretrievably broken down
and requires to be dissolved in accordance with law. In
furtherance of this objective, Sidhant Sharma, respondent No.
4, agreed to pay a sum of ₹37,00,000/- (Rupees thirty seven
lakhs only) to the appellant, Divya Sharma, in full and final
settlement of all her claims, including permanent alimony;
past, present and future maintenance; stridhan; and any other
financial claims. The first installment of ₹12,00,000/-
(Rupees twelve lakhs only) was paid to the appellant, Divya
Sharma, on 20.07.2026, at the time of signing of the
Settlement Agreement, by way of Demand Draft No. 141790 dated
08.07.2026 drawn on Indian Bank, Vasundhra Awas Vikas Branch,
in the name of the appellant, Divya Sharma. The second

installment of ₹12,00,000/- (Rupees twelve lakhs only) was
paid on 27.07.2026, by way of Demand Draft No. 141794 dated
27.07.2026 drawn on Indian Bank, Vasundhra Awas Vikas Branch,
in the name of the appellant, Divya Sharma. The last
installment of ₹13,00,000/- (Rupees thirteen lakhs only) was
paid today, when Demand Draft bearing No. 141795 dated
29.07.2026 for the said sum, drawn on Indian Bank, Vasundhra
Awas Vikas Branch, in the name of the appellant, Divya
Sharma, was handed over to her in open Court.
8. As the total settlement amount of ₹37,00,000/- (Rupees thirty
seven lakhs only) now stands paid to the appellant, Divya
Sharma, and the parties are ad idem that their marital tie
needs to be ended, we are of the opinion that this is a fit
case for exercise of our extraordinary jurisdiction under
Article 142 of the Constitution of India, to dissolve the
marriage between the appellant, Divya Sharma, and respondent
No. 4, Sidhant Sharma.
9. As the cases instituted by and between the parties and their
family members stemmed out of their marital discord and as
the same now stands settled owing to the amicable resolution
of all disputes by the parties, no purpose would be served in
allowing the litigation initiated by and between the parties
to continue, consuming the valuable time of the Court and the
parties themselves. In consequence, the following cases
(given in two tables) filed by and between the parties shall
stand quashed/disposed of: –

10. That apart, Sidhant Sharma, respondent No. 4, shall withdraw
Civil Suit No. 148/2026 bearing CNR No. UPGZ050017112025
pending before the learned 28-Civil Judge (Senior Division),
Ghaziabad, Uttar Pradesh. Further, as recorded in paragraph
6 of the Settlement Agreement, all cases/complaints/enquiries
initiated by and between the parties before any and all
Courts/authorities shall be understood to have been withdrawn
by them and the parties shall abide by their undertaking not
to revive any such case/complaint/enquiry. The cases that
stand disposed of, including Case No. 10774/2025 bearing CNR
No. UPGZ040122472025 before the learned Chief Judicial
Magistrate, Ghaziabad, Uttar Pradesh, filed by Praveen Kumar
Sharma, respondent No. 1, shall be allowed to rest and no
steps shall be taken to seek revival thereof.
11. I.A. No. 214817/2026 and the appeal are, accordingly,
disposed of, dissolving the marriage between the appellant,
Divya Sharma, and respondent No. 4, Sidhant Sharma, by way of
a decree of divorce by mutual consent, dispensing with the
statutory waiting period owing to the length of time that
they have already stayed apart. Registry shall draw up a
decree accordingly. Parties shall be bound by the terms and
conditions of their Settlement Agreement dated 20.07.2026.
In the event of breach of any such terms and conditions, the
party aggrieved is at liberty to seek specific performance of
the Settlement Agreement before the appropriate forum in

accordance with law.
