(i) Writ Petition is allowed and the order dated 17-01-
2023 passed by the LXXXI Additional City Civil and
Sessions Judge at Bengaluru in Special Case
No.577 of 2021 stands quashed qua accused No.5,
the petitioner herein.
(ii) The application filed by the petitioner under Section
227 of the Cr.P.C. for discharge in Spl.C.No.577 of
2021 stands allowed.
(iii) It is made clear that the findings recorded in the
present petition are only concerning the petitioner/
accused No.5 and it would not become applicable
or binding to any other accused facing trial in the
impugned proceedings.”
