    1. Heard learned counsel for the applicant and learned
    counsel for the respondent.

    2. This C24 application has been filed with the prayer
    to transfer the Original Suit No.1328 of 2023,
    “Dinesh Kumar Bhatt vs. Smt. Meena”, under
    Section 13(1)(i-a) of the Hindu Marriage Act, 1955
    and Original Suit No.959 of 2023, “Dinesh Kumar
    Bhatt and Others vs. Smt. Meena”, for permanent
    injunction under Section 7(1)(d) of the Family
    Courts Act, 1984 from Family Court, Dehradun to
    Judge, Family Court, Almora Camp, Ranikhet.

    3. Learned counsel for the applicant submits that the
    marriage of the applicant and respondent was
    solemnized on 23.10.2022; that soon after the
    marriage, the respondent and his family members
    started abusing the applicant and ousted her from
    the matrimonial home; that the respondent never
    made any attempt to bring the applicant back to
    matrimonial home; that the respondent is a lawyer
    by profession and is earning a handsome income;

    that the applicant has no source of income,
    therefore, it is difficult for her to survive with limited
    resources; that the applicant has also

    filed a Misc. Criminal Case No.78 of 2023, under the
    Domestic Violence Act, before the Judicial
    Magistrate Bhikiyasen, Almora for interim
    maintenance, which is still pending; that in the
    month of March, 2024 the applicant received
    summons from Principal Judge, Family Court,
    Dehradun, then she came to know that the
    respondent has filed the Original Suit No.1328 of
    2023, “Dinesh Kumar Bhatt vs. Smt. Meena”, under
    Section 13(1)(i-a) of the Hindu Marriage Act, 1955 &
    Original Suit No.959 of 2023, “Dinesh Kumar Bhatt
    and Others vs. Smt. Meena”, for permanent
    injunction under Section 7(1)(d) of the Family
    Courts Act, 1984; that the applicant is residing with
    her mother at Almora and is fully dependent upon
    her and has no source of income so as to cover the
    long distance to Dehradun from Almora, where the
    above original suits are pending and that the
    respondent has filed the above Original Suits only
    for oblique intention.

    4. Learned counsel appearing for the respondent has
    filed objections to the transfer application, and has
    denied the facts of the application. In the Transfer
    Application, an interim order was passed on
    05.04.2024 and the Transfer Application is pending
    for the last two years and, as such, learned counsel
    for the respondent submits that in case the Transfer
    Application is decided by this Court then directions
    may be issued for early disposal of the above suits,
    as expeditiously within a period of six months or in
    stipulate time frame.

    5. In view of the fact that applicant is dependent upon

    her parents and has no source of income and is
    facing undue hardship, the instant C24 application
    is allowed. The Original Suit No.1328 of 2023,
    “Dinesh Kumar Bhatt vs. Smt. Meena”, under
    Section 13(1)(i-a) of the Hindu Marriage Act, 1955 &
    Original Suit No.959 of 2023, “Dinesh Kumar Bhatt
    and Others vs. Smt. Meena”, for permanent
    injunction under Section 7(1)(d) of the Family
    Courts Act, 1984 are directed to be transferred to
    Family Court, Almora camp, Ranikhet. The learned
    Court is directed to hear and decide the case as
    expeditiously as possible preferably within a period
    of six months.

    6. As a sequel thereto, the miscellaneous application,
    if any, shall also stands disposed of.

    7. Let a copy of this order be sent to the court
    concerned for compliance.
