1. Heard learned counsel for the petitioners, learned
G.A.-11 appearing for the State, as well as learned counsel for
the private respondents.
2. Learned counsel for the State submits that the
Patna High Court CWJC No.9843 of 2010(13) dt.27-07-2026

proceedings arise out of an order passed under the Bihar
Consolidation of Holdings and Prevention of Fragmentation
Act, 1956, which is one of the Scheduled Acts under the Bihar
Land Tribunal Act, 2009. It is, therefore, submitted that, in view
of the proviso to Section 15 of the Bihar Land Tribunal Act,
2009, the matter is required to be adjudicated by the Bihar Land
Tribunal.
3. Having regard to the aforesaid submission and in
terms of the proviso to Section 15 of the Bihar Land Tribunal
Act, 2009, the present matter is required to be adjudicated by
the Bihar Land Tribunal.
4. Accordingly, the Registry shall forthwith transmit
the entire records of the present case to the Bihar Land Tribunal,
Patna.
5. Having regard to the fact that the writ petition has
remained pending before this Court since long, it is clarified that
upon receipt of the records, the parties shall be at liberty to
mention the matter before the learned Tribunal for fixation of an
early date of hearing. On he matter being mentioned before the
Tribunal, the learned Tribunal is requested to accord priority to
the matter, proceed with the hearing expeditiously and make
every endeavour to dispose of the same, preferably within nine

months from the date of receipt of the records.
6. The writ application stands disposed of.
