Heard Mr. Tungrei Ngakang, learned counsel appearing
for the petitioners.
Issue notice, returnable within four weeks.
Mr. Shyam Sharma, learned GA entered appearance and
accepts notice on behalf of the respondents No. 1 to 3 through VC
platform, hence no formal notice is called for in respect of the said
respondent.
Petitioners are to take steps for service of notice upon the
respondents No. 4 to 6 by way of dasti service as well as by speed
post service.
Steps should be taken within one week and the petitioners
are to file an affidavit showing proof of service of such notice.
It is the case of the petitioners that because of the dispute
about the election and appointment of the Chairman of MGNREGS,
WP(C) No. 543 of 2026 & anr. Contd…/-

Sihai Khunou, Ukhrul, the Block Development Officer, Ukhrul, issued a
Notice dated 05-05-2026 notifying that the Office of the Block
Development Officer, Ukhrul, shall conduct an election for appointment
of the Chairman of MGNREGS, Sihai Khunou on 12-05-2026 at
12:00 PM in accordance with the prescribed MGNREGS Guidelines
and procedures.
It has been submitted by the learned counsel appearing for
the petitioners that, quite surprisingly, the said Block Development
Officer, Ukhrul, issued an order dated 02-06-2026 acknowledging and
recognizing Shri Ramngaining Horam (respondent No. 4) as the
Chairman of MGNREGS, Sihai Khunou, on the basis of the election
and resolution taken by Sihai Khunou Village Assembly/ Authority on
05-01-2026. According to the petitioner, the said order dated 02-06-2026
is quite contrary to the earlier Notice dated 05-05-2026 issued by the
Block Development Officer, Ukhrul. The learned counsel, accordingly,
prays for passing an appropriate interim order.
Mr. Shyam Sharma, learned GA appearing for the
respondents No. 1 to 3 seeks ten days’ time to get instruction with
regard to the prayer for passing interim order and to consider the prayer
for passing interim order on the next date.
In view of the submission made by the learned counsel
appearing for the parties, let these cases be listed again on 12-08-2026
for consideration of the prayer for passing interim order.
