US Dept of Commerce imposes preliminary 6.99% countervailing duty on HEG’s graphite electrode exports, ETLegalWorld

    HEG Limited has disclosed that the U.S. Department of Commerce has issued a preliminary affirmative determination in its countervailing duty (CVD) investigation into large diameter graphite electrodes imported from India, setting a provisional CVD rate of 6.99 percent for the company.

    “The preliminary determination is subject to verification and final determination by the U.S. Department of Commerce,” HEG noted in an exchange filing.

    The company said it is “evaluating the impact” of the order and that the financial impact, if any, is “not ascertainable” at this stage.

    The investigation goes back to February 24, 2026, when the LDGE Fair Trade Coalition, backed by U.S. producers Resonac Graphite America and Tokai Carbon GE, filed AD/CVD petitions alleging that dumped and subsidised graphite electrode imports from China and India had depressed U.S. prices and hurt domestic shipments.

    The Department of Commerce formally initiated the investigations on March 17, 2026, alleging dumping margins of 42.59-73.40 percent for India.

    The U.S. International Trade Commission subsequently voted in April to continue the probes after finding a “reasonable indication” of material injury to the U.S. industry.

    HEG said the final CVD determination is currently scheduled to be announced alongside the final Anti-Dumping Duty ruling on December 8, 2026, unless the timeline is postponed, and it is cooperating with the U.S. Department of Commerce through the ongoing investigation, adding it will make further disclosures as required under applicable law.

    “The Company is cooperating with the U.S. Department of Commerce in the ongoing investigation and will disclose any further material developments, if required, in accordance with applicable laws,” said HEG.

    Notably, HEG already carries a separate 16.04 percent anti-dumping duty on its graphite electrode exports to the Eurasian Economic Union, a measure extended through March 2029.
