    02. 1. Heard learned counsel for the Petitioner and
    the learned counsel for the State.

    2. The Petitioner is seeking pre-arrest bail in
    connection with G.R. Case No.600 of 2006 pending
    on the file of learned J.M.F.C., Nimapara, arising out
    of Kakatpur P.S. Case No.144 of 2006 for commission
    of offences punishable under Sections 418/420/294/
    506/406/34 of the IPC.

    3. It is submitted by learned counsel for the
    Petitioner that notwithstanding that the case at hand
    is an offshoot of a complaint case and since NBWA
    has been issued, there is apprehension of arrest.
    Hence, he may be protected by pre-arrest bail.

    4. Learned counsel for the State opposes such
    prayer for pre-arrest bail.

    5. The This Court is conscious of the judgments
    of Apex Court in the case of OM Prakash
    Chhawnika @ Om Prakash Chabnika @ Om
    Prakash Chawnika v. State of Jharkhand &
    another
    ; 2026 SCC OnLine SC 676 which was
    followed in case of Ram Pukar Yadav & another v.
    State of Bihar & another
    ; SLP (CRL.) No. 11260
    of 2026. But in the factual matrix of the case, since
    NBWA has been issued, it is directed that on
    surrendering within three weeks hence and moving
    for bail, Petitioner shall be released on bail by the
    learned Court in seisin on such terms as deemed just
    and proper.

    6. The ABLAPL is accordingly disposed of.
