1. The hearing has been conducted through video conferencing.
2. Mr. Devesh Gautam, counsel appearing for the Petitioners, states that,
pursuant to the notices issued by this Court, he has been contacted by the
legal representatives of Petitioner Nos. 2, 3 and 4, namely, Gulab Singh, Jai
Gopal and Kailash Chander, who have since passed away. He seeks time to
file appropriate applications for bringing their legal representatives on
record.
3. Mr. Sanjay Kumar Pathak, counsel appearing for the GNCTD,
submits that although the Respondents’ right to file a counter affidavit
stands closed, the issue raised in the petition requires the stand of the
Government to be placed before the Court. He accordingly seeks permission
to file brief written submissions, together with the relevant official records.

4. The petition has remained pending for nearly ten years and the
controversy raised therein continues to survive. In these circumstances, the
Court considers it appropriate that the matter be placed in a position for
effective adjudication. The request made on behalf of the GNCTD is,
therefore, accepted, without reopening its right to file a counter affidavit.
5. The following directions are accordingly issued:
i. The Petitioners shall forthwith take appropriate steps for bringing on
record the legal representatives of deceased Petitioner Nos. 2, 3 and 4.
ii. Counsel for the parties shall file brief written submissions, not
exceeding three pages, within the same period, with advance copies to each
other.
iii. The GNCTD may place on record the official documents relevant to
the issue raised in the petition. Such filing shall not be treated as restoration
of its right to file a counter affidavit. The Petitioners shall be at liberty to
respond to any new material sought to be relied upon.
