O R D E R
Heard learned counsel for the parties.
2. The petitioner-applicant is accused in a case filed under the
Negotiable Instruments Act, 1881 (for short, the “N.I. Act”) by the
respondent-complainant alleging non-encashment of one post-dated
cheque issued by the petitioner-applicant in favour of the
respondent-complainant, totalling a sum of Rs.27,00,000/- (Rupees
Twenty Seven Lakhs).
3. Upon trial, the petitioner-applicant was convicted and
sentenced to undergo simple imprisonment of six months and to pay a
sum of Rs.27,00,000/- (Rupees Twenty Seven Lakhs) being the value
of the cheque as compensation and in default, simple imprisonment

The
Reason:
conviction and sentence of the petitioner-applicant was
affirmed by the Appellate Court as well as by the High Court of
2Madras, Madurai Bench. The said order was confirmed by this Court
by order dated 26.08.2025 passed in SLP(Crl.) No.13850 of 2024.
4. The present Miscellaneous Application has been filed seeking
compounding of offence as alleged in the present case. The basis
for filing the present Miscellaneous Application is that the
petitioner-applicant is ready to discharge his entire liability of
the amount of compensation with further offer of paying some amount
beyond the said compensation as awarded by the Court below.
5. Today, the parties have left the matter to the Court for
deciding what should be the extra amount, which the petitioner-
applicant needs to pay to the respondent-complainant.
6. Since the petitioner-applicant had already deposited a sum of
Rs.10,00,000/- (Rupees Ten Lakhs) before the Trial Court, from the
principal amount, a sum of Rs.17,00,000/- (Rupees Seventeen Lakhs)
is still outstanding.
7. Thus, in such view of the matter, in the considered opinion of
the Court, the ends of justice would be served, if the petitioner-
applicant pays a sum of Rs.20,00,000/- (Rupees Twenty Lakhs)
instead of Rs.17,00,000/- (Rupees Seventeen Lakhs) to the
respondent-complainant. The same, having been accepted by the
learned counsel for the respondent, be done within four weeks from
today and shall be directly paid to the respondent-complainant.
8. Further, the respondent is entitled to withdraw the sum of
Rs.10,00,000/- (Rupees Ten Lakhs), as deposited by the petitioner,
from the Trial Court, along with whatever interest, if any, which
may have accrued on the same.
9. To simplify/facilitate the matter, let the details of the bank

account of the respondent be provided by the learned counsel for
the respondent to the learned counsel for the petitioner within two
days from today.
10. Accordingly, I.A. No.291295 of 2025 along with Miscellaneous
Application stand disposed of. The order dated 26.08.2025 passed in
SLP(Crl.) No.13850 of 2024 dismissing the Special Leave Petition in
limine is recalled and the Special Leave Petition is restored to
its original file and number.
11. Leave granted.
12. For the facts and reasons recorded above and there being
compromise between the parties and as per Section 147 of the N.I.
Act providing for compounding, the Complaint Case bearing STC
No.417 of 2016 filed by the appellant against the respondent stands
compounded. The conviction and sentence of the appellant in the
said case is set aside. The appeal is allowed.
13. We indicate that in case there is default, the present order
shall automatically stand vacated and consequences shall ensue for
the appellant.
14. Pending application(s), if any, shall stand disposed of.
