    1. By this appeal, the appellant has challenged judgment

    SPONSORED

    and order dated 14.9.2015 passed by learned Additional

    Sessions Judge, Darwha, district Yavatmal (learned Judge of

    the trial court) in Sessions Trial No.39 of 2014 whereby

    respondent Nos.2 and 3 (the accused persons) are acquitted

    of offences under Sections 302 and 201 read with 34 of the

    IPC.

    2. Brief facts necessary for disposal of the appeal are as

    under:

    Ramesh Ganesh Parise (the deceased) was son of

    Ganesh Champat Parise (complainant). Accused Bandu

    Champat Parise, is step-brother of the complainant. On

    24.2.2014, at about 2:00 pm, the deceased along with the

    accused persons left house and proceeded towards field of

    accused Bandu. At about 5:00 pm, accused Bandu returned to
