    1. By this common judgment, afore-titled two petitions,

    one filed by M/S. Ali Mohammad Baba through its partner

    SPONSORED

    Manzoor Ahmad Baba under Section 29-A of the Arbitration

    and Conciliation Act, seeking extension in time for making
    CM No.5905/2024 c/w

    of award by the appointed Arbitrator, and the other bearing

    WP(c) No.2654/2024, filed by the Government of Union

    Territory of Jammu and Kashmir, challenging order dated

    26.07.2024 passed by the learned Sole Arbitrator, are

    proposed to be disposed of.

    2. The facts giving rise to the filing of these two petitions

    are that various disputes arose between M/S Ali Mohammad

    Baba (hereinafter “the contractor”) and the Government of

    Union Territory of Jammu and Kashmir (hereinafter “the

    employer”), with regard to execution of the contract relating

    to design, supply, installation, testing and commissioning,

    including maintenance and operation for three years of

    street lighting on four way National Highway Bypass all

    along the central verge from Athwajan to Parimpora on

    turnkey basis.
