The Court: This is an application filed by the defendant no.1 under
Section 8 of the Arbitration and Conciliation Act, 1996.
In the pending arbitration between the parties, Learned Arbitral
Tribunal in the last meeting held on July 1, 2026 had recorded as follows:

"Mr. Banerji concludes his argument.
Both parties agree to file their written notes of their
respective submissions and pray for three weeks' time for the
same. The parties are accordingly given time to file their written
notes of argument on or before 22nd of July, 2026. It is made
clear that the written notes will be filed by the parties directly
with the Tribunal and will not be exchanged. The Tribunal
proposes to hold another sitting for any queries that it may
have on the written notes filed by the parties. For the purpose
the next sitting of arbitration is fixed on 11th August, 2026 at 5
p.m.
The parties are requested to clear all outstanding fees of
the Tribunal and its secretarial staff, if any, on or before 28th
July, 2026."
Copy of the minutes dated July 1, 2026 placed before this Court is
taken on record.
It appears from the recording of the Learned Arbitral Tribunal that
both parties agreed to file their written notes of their respective submissions
and prayed for time for the same.
Be that as it may, Mr. S. K. Kasera, learned Advocate appearing for
the plaintiff/SESA International Limited prays for an adjournment of
hearing on the ground that his arguing counsel has not come to Court
today.
Affidavit in opposition filed by SESA International Limited in Court
today is taken on record.
