Hon'ble Vivek Bharti Sharma, J. (Oral)

By means of present petition, petitioners seek to
quash the charge-sheet and the cognizance orders dated
10.02.2023 and 03.05.2023 passed by A.C.J.M., Roorkee,
District Haridwar as well as the entire proceedings of
S.T. No.44 of 2023 “State vs. Bisarat” and S.T. No.83 of 2023
“State vs. Azam and another
” (leading S.T. No.53 of 2023),
under Sections 307, 323, 504, 506, 34 of IPC, in view of the
compromise arrived at between the parties.

2. In view of the fact that a Compounding Application
was filed by the parties before this Court, this Court, vide order
dated 09.04.2025, had directed the parties to appear before the
Secretary, DLSA, Haridwar to get their statements recorded and
to verify the compromise deed.

3. Pursuant to such order, Secretary, DLSA, Haridwar
has submitted report dated 15.04.2025 which indicates that the

parties have settled the dispute amicably and have also verified
the contents of the compromise.

4. In view of the above, Compounding Application IA
No.1/2024 is allowed. As a consequence thereof, impugned
charge-sheet and the cognizance orders dated 10.02.2023 and
03.05.2023 passed by A.C.J.M., Roorkee, District Haridwar as
well as the entire proceedings of S.T. No.44 of 2023 “State vs.
Bisarat
” and S.T. No.83 of 2023 “State vs. Azam and another

(leading S.T. No.53 of 2023) under Sections 307, 323, 504, 506,
34 of IPC, are hereby quashed qua the petitioners.

5. Accordingly, present petition is disposed of, on the
basis of compromise/settlement arrived at between the parties.
