Learned counsel for the appellants seeks leave to withdraw

the aforesaid appeal since the appellants have been informed

that the Department is considering granting gratuity to the

appellants. She, however, seeks leave to file a fresh appeal in the

event, an occasion, so arises in future.

The appeal is disposed of with liberty as prayed.

We make it clear that we have not gone into the merits of

this appeal, and as such, keep all contentions of all parties on

merits open.
