The Criminal Petition has been filed under Section 482 of the Code of

Criminal Procedure, 1973 (for brevity ‘the Cr.P.C.,’)/Section 528 of the

Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) seeking to

quash proceedings against petitioners/Accused Nos.1 to 4 in Cr.No.92 of

2025 on the file of the Palakoderu Police Station, West Godavari District,

registered for the alleged offence punishable under Sections 318(4) and

351(2) read with 3(5) of the Bharatiya Nyaya Sanhita, 2023 (for brevity, ‘the

BNS’).

2. Heard the learned counsel for the petitioners and the learned Assistant

Public Prosecutor. Perused the record.

3. As seen from the record, Accused No.1 is running a proprietary firm by

name Global Solutions. It is alleged that he, along with the other petitioners,

lured Respondent No.2 that they would erect a cell tower. On that assurance,

Respondent No.2 invested substantial amounts. However, the cell towers

were neither erected nor the invested amount was repaid to Accused No.1. It

is submitted that Accused No.2 is an employee of the firm owned by Accused

No.1. Accused No.3 is the father of Accused No.2, and Accused No.4 is the

brother of Accused No.2. Respondent No.2 lodged a complaint against

Accused No.1 and the other petitioners. The said complaint was registered as

Crime No.92 of 2025 on the file of Palakoderu Police Station, West Godavari

District, for the alleged offences punishable under Sections 318(4) and 351(2)

seven years.
